GENERAL TERMS FOR PARTICIPATION IN THE SUMMER SCHOOL IN SHANGHAI 2018

 

  1. INTRODUCTION

Company ELMA d.d., Cesta 24. junija 23, 1231 Ljubljana-Črnuče, publishes the General Terms and Conditions for the Contract for participation in the summer school 2018 at the Donghua University in Shanghai (summer school provider). General Terms and Conditions are an integral part of the Contract.

The Coordinator does not organise a travel but is an authorised partner of the summer school for collecting applications, selecting participants, administrative and technical responsibilities.

  1. APPLICATION AND CONCLUSION OF THE CONTRACT

Signing up for summer school takes place through web applications on the  www.shanghaisummerschool.org website. After the execution of the application, the Participant receives an e-mail, the reply to which confirms the application. The Participant can make application and confirmation by 15 March 2018 or later with Coordinator’s consent. By submitting an application through the online application and paying the first instalment, the Contract is deemed to have been concluded and the Participant accepted these General Terms and Conditions as binding and approved. By concluding the Contract, the Participant is deemed a Participant under these General Terms and Conditions.

After the expiration of the application deadline or when the deadline for withdrawal expires, the Participants receive an e-mail with an invitation to an official interview, which is expected to take place over Skype one week after receiving the application. At the official interview, the Coordinator checks the suitability of the Participant. After the interview, the selected Participants receive a confirmation email, together with an invoice for the first instalment (payment period is 8 days). If the Participant does not pay the invoice within 8 days, the Coordinator reserves the right to withdraw the selected Participant from the list of selected Participants, and the selected Participant loses the right of registration or is deemed to have resigned from the Contract. The Participant can only withdraw from the Contract in accordance with the provisions on cancellation of participation (see point 5).

In the event that the Participant does not give correct data upon registration, the Participant must bear all the costs and other consequences of incorrect data.

The Coordinator reserves the right to refuse the Participant, after conducting the interview, as unfit to participate in the summer school without specific reasoning. In this case, the Participant will be informed of the refusal within 8 days after the interview has been completed and will receive a refund of the first instalment.

  1. PAYMENTS

Immediately after confirming the application, the Participant will receive an invoice of 90 EUR for the first instalment, which he must pay to the Coordinator within 8 days of receipt of e-mail with the first instalment invoice.

The Participant receives a second instalment invoice of 500 EUR by e-mail on 25 March 2018 and must settle it within 8 days of receipt of the e-mail. If the Participant has carried out the application and paid the first instalment before 31 December 2017, the second instalment is 300 EUR. If the Participant applied between 1 January 2018 and 1 February 2018, the second instalment is 400 EUR.

The Participant receives the invoice for the third instalment for EUR by e-mail on 1 May 2018 and must settle it within 8 days after receiving the invoice.

In case of non-payment of the second or third instalments within the set deadlines, the Coordinator will subsequently request from the Participant to settle the invoices within 8 days of receiving Coordinator’s e-mail. In case of non-payment within the extended deadline, the Coordinator has the right to refuse the application and retain the received payments as compensation for administrative costs.

  1. SUMMER SCHOOL FEE

The summer school fee includes attendance at the summer school (a 67-hour Chinese language course run by guest speakers), the cost of a letter of invitation from the Chinese authorities for obtaining a visa, a certificate of completion of the summer school, accommodation (accommodation in a double room in the campus of Donghua University), a textbook and all the costs of afternoon lectures, visits to the city of Suzhou and a night cruise on the Huang Pu River by visiting the Shanghai Tower.

The total price of the summer school (excluding the reduction of the second instalment) amounts to 1390 EUR.

  1. TERMINATION OF PARTICIPANTS FROM THE TREATY

The participant has the right to withdraw from the Contract. In the event of termination, the Participant does not have the right to cancel the payments already paid to the Coordinator, except in the case mentioned in the next paragraph.

The Participant has the right to withdraw from the Contract within 14 days of the conclusion of the Contract (application for the summer school) without giving any reasons. The Participant withdraws from the Contract by e-mail, which must be sent from the e-mail address given by the Participant in the application to the e-mail address: nihao@shanghaisummerschool.org.

After the deadline specified in the above paragraph, the Participant takes over the risk of a possible withdrawal, whereby the loss of the right to return the paid instalments up to the price indicated in Article 4 of these General Terms and Conditions. It is considered that with the already paid instalments the Coordinator shall bear his own costs and losses incurred;

If the Participant wishes to withdraw from participating in the summer school, he must submit a written resignation by e-mail to nihao@shanghaisummerschool.org.

If, during the summer school, the Participant does not attend the summer school courses or does not attend them regularly, he shall be deemed to have withdrawn from the participation in the summer school, thereby losing the right to further participation. In this case, the Participant is not entitled to any reimbursement of the expenses or any refunds for the summer school from the Coordinator. In this case, the Participant shall be liable to the Coordinator for all costs or damages caused by the non-participation.

  1. COORDINATOR’S RIGHT TO CHANGE THE PROGRAMME OR CANCEL THE SUMMER SCHOOL

The Coordinator is not liable to the Participant for cases when the summer school programme changes, including the change of summer school terms. In the case of changing the programme of the Summer School, the Participant shall not be entitled to claim any refund of money, compensation for damages or costs or a reduction in the price of the summer school.

The Coordinator reserves the right to cancel the Contract no later than two (2) months before the beginning of the summer school, in case of an insufficient number of participants.

The Coordinator reserves the right to terminate the Contract if exceptional circumstances that could not have been foreseen in advance are avoided or excluded prior to or during the execution of the programme.

The Coordinator may withdraw from the Contract and require the Participant reimbursement if the Participant has violated the provisions of the Contract concluded with the Coordinators, especially if the Coordinator finds that the Participant presented the Coordinator with incorrect data.

In the event that the Coordinator withdraws from the Contract, the Participant is entitled to repayment of the total amount of paid invoices. These examples are not considered when the reasons for non-participation are on the side of the Participant (including the cases referred to in Article 5 of the General Conditions).

In no case shall the Coordinator be liable for the reimbursement of the participant’s expenses, such as airfare and travel expenses in general, the costs of the visa or the cost of health insurance or vaccination.

The Coordinator informs the Participant of any changes in the shortest possible time on SummerSchol@Shanghai.si.

Any damage that would result from the fact that the Participant submitted false information is borne by the Participant himself.

  1. TRAVEL, DOCUMENTS AND LOSS OF DOCUMENTS, LUGGAGE, PERSONAL ITEMS

The Participant must take care of his trip to the summer school and back. The Coordinator is not responsible for the Participant’s travel, but will inform the Participant of the relevant facts (e.g. ticket prices) to the best of his ability.

The duty of the participant is to inform about all applicable travel restrictions, visas (e.g. validity of the travel documents, which must be valid for at least 6 months from the arrival in the country of travel at the time of the adoption of the general conditions), customs and health restrictions, to successfully enter the country of travel.

In the event that the Participant fails to enter the summer school for any reason, this is, in any case, his responsibility and is deemed to have terminated the Participation agreement.

  1. PARTICIPANT’S OBLIGATIONS

 The Participant must provide the Coordinator with data that are true and identical to those on the participant’s official documents. In addition, the Participant is responsible for giving the correct other information, this expressly refers to the correctness of the electronic mail address.

As a rule, the Coordinator communicates with the Participants via e-mail. The Participant must therefore ensure that his e-mail address is operational and accessible.

If the Participant gives false information and this causes delay or additional costs to other Participants of the summer school, the Participant shall be fully liable for the costs incurred and the damage caused to the other Participants of the summer school.

The Participant is obliged to respect the house rules of accommodation and classrooms and to cooperate with the representative of the Coordinator and service providers in good faith. At the summer school, the Participant must behave in a manner that does not compromise the lives or health of his companions or threatens the implementation of the summer school programme. If the Participant fails to fulfil his duties, he is responsible for the costs and damage caused to the Coordinator. The Coordinator is not responsible for any costs or damages suffered by the Participant in these circumstances. If the Participant fails to act in accordance with these provisions, the representative of the Coordinator has the right to remove him from the continuation of the summer school without reimbursement of any costs or damages.

The Participant must agree with the home institution to obtain ECTS credits for attending the summer school.

If the Participant has to interrupt the summer school due to loss of documents, he is not entitled to reimbursement of expenses or damage.

The Coordinator is not responsible for personal belongings and possessions of the Participant.

  1. FINAL PROVISIONS

All prices in this offer are final.

These General Terms and Conditions apply from the time of adoption.
